PERFORMANCE MODIFICATION DISCLOSURE & AGREEMENT
What you agree to when you pay the $500 booking fee to book your car in and arrange a consult with our dyno tuner. Please read it before you tick to accept.
Version 2026-10-21 · last updatedThe short version: a performance build puts more load on your engine and drivetrain, and no result is guaranteed. Tell us everything you know about your car. Our tune stays ours: don’t copy, read out, resell or share it. Hardware parts we supply carry a lifetime warranty while the car is serviced by us or an accredited dealer at least once a year and every 6,000 km. Your $500 is credited to your final invoice. Your rights under the Australian Consumer Law always apply.
01About this agreement
This agreement is between you, the customer booking the car in, and CADE Technologies, 2/11 Creswell Road, Largs North SA 5016 (“we”, “us”). It applies to the performance work we quote you through our package builder or in person: ECU calibration (tuning), the hardware parts we supply and fit, and the dyno time and consult that go with them.
You accept it by ticking the box before you pay the booking fee. We record the version you accepted, the date and time, and your quote reference with your booking. If we change this agreement, the version number above changes, and a booking already made stays under the version accepted with it.
Nothing in this agreement excludes, restricts or changes any right or remedy you have under the Australian Consumer Law or any other law that can’t be excluded. If a part of this agreement would do that, it doesn’t apply to that extent.
02The $500 booking fee
- The booking fee is $500. It books your car in and arranges a consult with our dyno tuner about your build.
- We credit the full $500 against the final price of your job when the job is complete. It is not an extra charge on top of your quote.
- Your quoted price is confirmed after we inspect the car and run it on the dyno, before any work starts. If the inspection changes the price, we tell you first and you decide whether to go ahead.
- If online payment isn’t available when you book, we email you a secure payment link for the $500. Your booking is confirmed once it’s paid.
03Modification risks
Please understand these before you go ahead:
- Added mechanical stress. More power and torque put more load on the engine, turbochargers, gearbox, clutch or torque converter, driveshafts, differentials and cooling system than the manufacturer designed for. Parts can wear faster or fail sooner than they would on a standard car.
- Results aren’t guaranteed. Power, torque and dyno figures depend on your car’s condition, fuel, weather and the dyno itself. Figures we quote or publish from other cars are examples, not a promise for yours.
- Existing condition and wear. A modified car shows up wear and faults that were already there. We aren’t responsible for a failure caused by a part’s existing condition or wear, or by a fault the car already had. If our inspection or dyno run shows a problem, we stop and tell you before going further.
- Manufacturer’s warranty. Modifying your car may affect a claim under the manufacturer’s warranty for related parts. Check with your dealer before you book if your car is still under its factory warranty.
- How the car is used. How the car is driven, serviced and fuelled after the work affects how long the engine and drivetrain last.
04What you must tell us
Before we start, you must tell us everything you know about the car that could affect the work, including:
- faults, warning lights, noises, leaks, smoke, oil or coolant use, and anything that has been repaired;
- earlier modifications and tunes, and who did them;
- accident, flood or overheating damage;
- how the car is used, such as track days.
If you don’t tell us about a fault or modification you knew about, we aren’t responsible for a failure it causes.
05Engine and drivetrain failure
We carry out every job with due care and skill. Because of the risks in section 03, to the extent the law allows, we aren’t liable for failure of or damage to your engine, turbochargers, gearbox, clutch, driveline or other parts after performance work, or for loss that follows from it (such as towing, hire cars or time off the road), except where the Australian Consumer Law or another law says otherwise, for example where the failure is caused by our failure to meet a consumer guarantee.
06Our calibrations are confidential
The calibration (tune) we write for your car, and the files, maps and settings in it, belong to CADE Technologies and are confidential. You get the right to use it on the car we tuned. You must not, and must not let anyone else:
- copy it, or read it out of the ECU or any other control unit;
- sell, give or send it to anyone, or load it onto another car;
- change, reverse-engineer or publish it.
If someone else reads out, changes or overwrites our calibration, we can’t support that car’s tune until we’ve checked it, and the cost of putting it right isn’t covered by us.
07Lifetime hardware warranty
We give a lifetime warranty on the hardware parts we supply and fit as part of your build (for example downpipes, intakes and exhausts) against defects in materials and manufacture. It covers hardware only: it doesn’t cover software, calibrations or tuning, or the engine and drivetrain parts the build puts more load on.
The condition
The warranty applies only while the car is serviced by CADE Technologies or an accredited dealer at least once a year and every 6,000 km, whichever comes first. Keep your service records: we’ll ask for them with a claim.
What it doesn’t cover
- Damage from an accident, misuse or neglect.
- A part that someone other than us or an accredited dealer has removed, repaired or modified.
- Normal wear, and how a part looks over time (such as heat colouring on exhaust parts).
How to claim
Contact us (details below) with your name, car, rego and quote or invoice reference, and tell us what’s wrong. Bring the car to our Largs North workshop, with its service records, so we can inspect the part. If the claim is covered, we repair or replace the part. Getting the car to our workshop is at your cost; repairing or replacing a covered part is at ours.
The benefits of this warranty are in addition to other rights and remedies you have under a law in relation to the goods or services to which the warranty relates.
08Refunds
We don’t offer refunds beyond what the Australian Consumer Law requires, including for a change of mind. Your rights under the Australian Consumer Law, set out below, always apply.
09Your consumer guarantees
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:
- to cancel your service contract with us; and
- to a refund for the unused portion, or to compensation for its reduced value.
You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.
